Hargeisa- The Justice and Welfare Party filed today a case at the Commission of Registration of Political Associations and Certification of Political Parties demanding removal of seven members of local councils in different districts because, the Party argues, they lost their membership by joining another party.
The sued members including the mayor of the port city of Berbera, Abdishakur Mohamoud, and the mayor of Gabiley, Mohamed Omar, were elected in 2012 under the banner of the Justice and Welfare Party, but in February they declared that they abandoned their original party and moved to the ruling party.
Infuriated by their action, the Party leadership says the law prohibits elected members of local government councils or parliament to leave their parties. For that reason the members lost the membership and shall be replaced by the members in the waiting list, the Party said.
The Constitutional Court in last week ruled that the case has to be heard by the Commission after the Party filled a constitutional case at the court.
The Commission after hearing the arguments of the two sides will make its decision.
